HazardKoh      ( Date: 10-Aug-2017 18:22) Posted: The Board wishes to update that whilst discussions have been ongoing with the Group&rsquo s principal lenders in relation to the Restructuring options, the Company and its wholly-owned subsidiary, Nam Cheong Dockyard Sdn Bhd (" NCD" ), have on 9 August 2017 received a writ of summons and statement of claim dated 7 August 2017 filed by AmBank (M) Berhad (" AmBank" ) in the High Court of Malaya at Kuala Lumpur, Malaysia (the " Writ of Summons" ). Pursuant to the Writ of Summons, AmBank is claiming against NCD as borrower under credit facilities granted by AmBank and against the Company as guarantor of the said facilities for the sum of RM70,402,636.90 as at 31 July 2017, together with interest and costs on a solicitor-client basis allegedly due to AmBank for the breach of the facilities. The Company and NCD are currently reviewing the Writ of Summons and seeking legal advice on this matter. Further announcements will be made by the Company and the Board via SGXNET as and when there are any material developments in compliance with the listing rules of the Singapore Exchange Securities Trading Limited.

x 0   x 0  Alert Admin	You may not reach out to many noteholders through this forum. namcheongbond      ( Date: 24-Jul-2017 22:04) Posted: I encourage all bondholders (regardless of which series) to tell their relationship manager to request that DBS Trustee   give notice to Nam Cheong that all notes with accrued interests are immediately due and payable because an Event of Default has occured under clause 9(f) of the info memo dated 30 June 2015 (see page 37) due to the missed interest payment on 23 July 2017.   All bond trustees are by nature very passive and will not do anything until requested by bondholders to do so.   That' s why Nam Cheong said it will work with DBS Trustee on the missed interest payment because it knows DBS Trustee will not do anything about it until it hears something from the bondholders.   So as bondholders, we need to take the initiative and request through our RM that DBS Trustee give notice to  Nam Cheong that all notes along with accrued interests are immediately due and payable.   We need as many bondholders to communicate to your RM as possible because DBS Trustee will not act until at least 25% of bondholders request it to do so.

Funny that banks treats individual debtors whose loan is small in comparison like shit while sayang sayang listed co whose loan are huge like king

"Face" is public give " disgrace" is ownself created... namcheongbond      ( Date: 22-Jul-2017 22:54) Posted: I believe an &ldquo Event of Default&rdquo took place when Nam Cheong announced on 20 July 2017 that it would not be paying the bond interest due on 23 July 2017.  According to Section 9(f) of the Medium Term Note Information Memorandum dated 30 June 2015 (see page 37), any threats &ldquo to stop or suspend payment of all or any part of (or of a particular type of) its indebtedness&rdquo is considered an &ldquo Event of Default&rdquo .  The MTN Information Memorandum can be found on SGX website   ( http://www.sgx.com/wps/portal/sgxweb/home/company_disclosure/prospectus_circulars ) if anyone is interested.    If sufficient bondholders (> 25%) request DBS Trustee to act, it may at its discretion &ldquo give notice to the relevant Issuer that the Notes are immediately repayable&rdquo   Nam Cheong will of course ignore this (like they did to the Writ of Summons from OCBC) and stall for additional time. But I believe giving notice of an &ldquo Event of Default&rdquo might encourage the controlling family to negotiate more seriously and will put the bondholders on more solid legal grounds to apply for judicial management (if necessary) down the road.
