Creative awarded S$36 million in legal proceedings against Huawei

CREATIVE Technology and its subsidiary QMax Communications on Wednesday updated that the Court has issued its judgement, holding Huawei International liable for misrepresentation and being " grossly negligent" when it was vendor for Creative' s wireless broadband project.
CREATIVE Technology and its subsidiary QMax Communications on Wednesday updated that the Court has issued its judgement, holding Huawei International liable for misrepresentation and being " grossly negligent" when it was vendor for Creative' s wireless broadband project.
The Court also held that Huawei was liable for breach of contract. Consequently, the Court ordered Huawei to pay Creative and QMax a total of about S$36 million, inclusive of interest to-date.
Earlier, Creative and QMax had sought to recover damages and all losses suffered in relation to its wireless broadband project against Huawei for misrepresentation or alternatively, for breach of contract.
Huawei had in turn filed a counterclaim seeking relief which included damages for the alleged wrongful rescission and/or termination of the contract. Huawei' s counterclaim was ultimately dismissed.
 
In addition, costs of the legal proceedings were awarded to Creative and QMax.
Creative said in its statement: " The judgment is appealable to the Court of Appeal. In the event that the judgment is not appealed, the judgment sums will be recognised in the company' s financial statements for the current quarter ending 30 September 2017.

Honestly SGX is not truly a stock exchange.   It is more or less a quick sand exchange.   You step on it you bound to sink unless you have tied a rope around your waist first.   Lol.

Creative Subsidiary ZiiLabs Settles Patent Infringement Lawsuits in the United States Creative Technology Ltd (&ldquo Creative&rdquo ) today announced that its wholly owned subsidiary, ZiiLabs Inc., Ltd (&ldquo ZiiLabs&rdquo ) has entered into an agreement with patent aggregator, RPX Corporation (&ldquo RPX&rdquo ) and as a result has settled ZiiLabs&rsquo patent infringement lawsuits filed in the United States in 2016 as previously announced on 3 September 2016 and 17 December 2016. As part of the agreement, ZiiLabs will receive payment from RPX and assign certain rights in its patent portfolio to RPX. Creative expects the payment will contribute approximately US$0.44 of earnings per share to the current quarter ending 30 September 2017.

Creative is a strong sell and short now. Is now or never. Don't say I never warned you okay!
Now is the best time to sell. Based on history, Creative cannot maintain the upward momentum. And there' s no suggestion that this time will be different.
Please sell or short now, or else you might need for a long time for a good chance to get out!
