According to Brandt, " approximately 65" parties, some of who participated in the aborted 2016 sale process of China Fishery, have expressed interested in the sale and " several" have signed confidentiality agreements allowing them access to a data room with due diligence information.

Bank fights court-ordered release of China Fishery documents

UK-based lender HSBC Bank is appealing a New York judge' s order allowing the trustee of China Fishery Group to subpoena documents related to the bank' s conduct prior to the group' s 2016 bankruptcy filing.

William Brandt, the trustee overseeing China Fishery, the Peruvian fishmeal and fish oil arm of Hong Kong-based Pacific Andes International Holdings (PAIH), had sought to invoke a provision in US bankruptcy law known as Rule 2004 to subpoena records and compel testimony from HSBC. The trustee wants to investigate actions that the bank, which had lent over $200 million to PAIH and subsidiaries, took as part of debt recovery efforts it took beginning in 2014. 



Wow, what if China Fishery proved HSBC tried to pull a fast one? Can sue them for losses?

 

While the liquidators were eventually withdrawn, their appointment caused " irreparable damage" to China Fishery' s ability to obtain financing in Peru needed to maximize revenue from those operations, Ng claimed.

And in pollock processing -- Pacific Andes owns the largest whitefish re-processing factory in China, the Hongdao complex in Qingdao, while also using  contract factories -- the liquidators&rsquo appointment  allegedly led some lenders to cut credit  which was used to buy raw materials, which had an &ldquo adverse impact&rdquo on that business, the company said.



And now even Pac Andes also dragged into the saga.

Actually, I still think there' s some hope, not too much perhaps, but still there' s hope.  If we look at the filings under Cap 11, we' d see many, including global household American names, having  emerged perhaps even stronger.  Recall in the aftermath of the 2009 GFC even coys like GM went through Cap 11?  N if we look at CFG' s filing on SGX on 1 Jul 16,  no matter how circumspect I am, I think it deserves a little benefit of the doubt.  On the other hand, I tend to have greater reservation on the article that one of our brother forumers has highlighted below which has suggested that shareholders wld very likely end up with nothing -  but this point seems  to me not well  supported.  My sense is that with CFG' s valuable anchovy quota n viable fishmeal ops in Peru, there seems reasonable chance of rejuvenating the coy.  So, while we shd be prepared for the worst case scenario, there' s possibly some hope left.  Cheer up brothers n sisters.
