I' m not sure if it' s one of those. But if it is, it has not violated the rules. Whom do we point the finger at? What abt the rule setters. Obviously they must have reviewed n found the rules n guidelines acceptable. Moreover, if SHY is able to move what they had built at a reasonable margin, are they not worth a look?
