x 0   x 0  Alert Admin	The lead independent director, Ter Kim Cheu, is the uncle of the non-independent non-executive director, Alain Ong. This fact somehow woke me up on a lazy Saturday morning. Mr Ter is a big time legal expert and so I hope he doesn' t sue me for my remarks, which are made more for clarification or discusson. This should be another interesting case study for Professor Mak. Interesting because granted that Mr Ter is appointed before Alain Ong, and if we assume Mr Ter passed all criteria for independence, would this independence be the same if we reverse the timing, i.e. if Alain Ong is first appointed as a non-independent ED before Mr Ter, would Ter be qulified as independent, to the point of being a lead ID? In this reversal of timing, if Alain Ong is instead appointed before Mr Ter as independent director, would Mr Ter be able to be appointed as ID? I think Prof Mak once mentioned a listed company whose executive chairman (or CEO) appointed his nephew as ID and the appointed was presumingly passed.
